ANCOM actualizează o serie de reglementări în domeniul comunicațiilor electronice

In a Consultative Council meeting, the National Authority for Management and Regulation in Communications (ANCOM) agreed on reviewing the obligations regarding the quality indicators for the Internet access service, on setting up a Single Information Point concerning the infrastructure owned by network operators and by public sector bodies, as well as on updating the obligations related to the transmission of information on the roll-out and geographical location of public electronic communications networks.
 
Review of the obligations regarding the quality indicators of the Internet access service
Concerning the obligations related to the quality indicators for the Internet access service, ANCOM brought the provisions of the national legislation in line with the European framework in the field and with the needs of the end users. Thus, the definitions of the following technical quality parameters have been laid down or updated: the minimum data transfer rate, the actually available transfer rate, the best-effort transfer rate and the advertised data transfer rate for fixed internet access services, as well as the values ​​of the estimated best-effort and advertised data transfer speeds, for the mobile internet access services. Furthermore, the providers have the obligation to make available to the public the values ​​of the technical parameters and the procedure for measuring these parameters, as well as the remedies available to consumers in case of any significant, permanent or regularly repeated discrepancy between the actual performance of the service and that indicated in the contract, in the modalities established by ANCOM through the decision agreed with the industry.
 
The measurement of the technical quality parameters will be done through Netograf.ro, the application made available to the users by ANCOM. Moreover, the providers have the obligation to make publicly available the values ​​of the administrative quality parameters for at least the past two completed semesters, by publishing them on their own site or by displaying them at all the work stations.
The decision on establishing the quality indicators will enter into force on 1 February 2018, excepting the technical quality parameters, which are to enter into force on 1 May 2018.
 
 
Information regarding the physical infrastructure of network operators, available with the Single Information Point

 

Starting next year, network operators and public sector bodies will report online to ANCOM, via a Single Information Point, the data they have, in electronic format, on the location, track, type and current use of the physical infrastructure they hold. With a view to the easier access to the network operators’ physical infrastructure, the providers of public electronic communications networks will also be able to access such information through the Single Information Point available on the Authority's website.
Failure to report these data and documents in compliance with the deadlines, the format and the way of transmitting them may be sanctioned by ANCOM with a fine from 1,000 to 100,000 lei.
 
 
National inventory of public electronic communications networks and associated facilities

 

The Authority has updated the format and modalities for transmission - by the providers of public electronic communications networks - of information on the roll-out and geographical location of public electronic communications networks and of the physical infrastructure elements associated with them.
Such information will be used by the Authority in order to carry out the national inventory of public electronic communications networks and of the associated facilities.
In order to carry out the inventory, ANCOM imposed the operators’ obligation to transmit both information on electronic communications network elements, such as the characteristics of network segments or equipment, as well as on the physical infrastructure elements associated with the network, i.e. facilities such as manholes, cabinets, ducts, masts or pillars.
Providers will have to submit these items of information, according to the legal provisions, within 6 months from the date of entry into force of the decision, whereas a minimum amount of information is to be transmitted within 30 days from the respective date.
