ANCOM to update the format of information on the roll-out and geographical location of public electronic communications networks

On 3 November 2017, The National Authority for Management and Regulation in Communications of Romania (ANCOM) launched for public consultation a draft decision establishing the format and means of sending information on the roll-out and geographical location of public electronic communications networks and of the associated facilities. The Authority will use such information in order to carry out the national inventory of public electronic communications networks and of the associated facilities.

Necessity to adopt the draft decision

This project needs to be adopted in order to update the format and means of transmitting such information by the electronic communications providers, following the adoption of Law no. 159/2016 regarding the regime of the physical infrastructure of electronic communications, as well as for the establishment of measures reducing the installation costs for electronic communications networks, which provides new responsibilities for ANCOM. This new draft decision repeals ANCOM Decision no. 1644/2014 for establishing the format and means of sending information on the roll-out and geographic location of public electronic communications networks and of the associated facilities. The project takes over most of the provisions of ANCOM Decision no. 1644/2014, the categories of information to be provided by providers being preserved.

New provisions in the draft decision

The draft decision further defines the category of providers under the obligation to transmit information, i.e. the providers of public electronic communications networks holding such networks, either as owners or as assignees.

New provisions have also been introduced stipulating the obligation of network operators and central or local public administration authorities that hold physical infrastructure elements as owners, administrators or assignees to transmit to ANCOM the information required to carry out the inventory.

Required information

In order to carry out the inventory of public electronic communications networks and of the associated facilities, ANCOM requests information on electronic communications network elements, such as the characteristics of network segments or of various pieces of equipment, as well as on elements of physical infrastructure associated with the networks, such as the characteristics of manholes, cabinets, pipes, pillars or masts.

Deadline for transmitting information

The providers will have to submit the information, according to the legal provisions, within 6 months from the date of entry into force of this draft decision.

With a view to correlating the provisions of the decision with the implementation of the Network Inventory Information System (NIIS), a first reporting phase was initiated and will take place between 21 and 29 November 2017, during which - taking into account the short term available to the providers, only a small amount of data will be transmitted using the application provided by ANCOM.

Entities obliged to report

This decision applies to the providers of public electronic communications networks holding – as owners or assignees - publicly available electronic communications networks or physical infrastructure elements associated with them.

The reporting obligations imposed on providers of public electronic communications networks through the draft decision under public consultation are differentiated according to the extent and complexity of the networks, as in the previous decision.

Moreover, network operators and central or local public administration authorities that hold physical infrastructure elements - as owners, administrators or assignees - will send to ANCOM, upon request, information required for carrying out the NIIS.

Public consultation process

The draft decision establishing the format and means of sending information on the roll-out and geographical location of public electronic communications networks and of the associated facilities is available, in Romanian, here. The interested persons are invited to submit their comments and suggestions, by 13.11.2017, at the ANCOM headquarters (2 Delea Noua Street, Bucharest 3), directly to the ANCOM Registry Office or by means of the ANCOM regional divisions.
