ANCOM conducted approximately 4,700 control actions in the electronic communications and postal services market

From the beginning of 2017, for ensuring the smooth functioning of the sector and the electronic communications and postal services providers’ compliance with the law in Romania, ANCOM has conducted almost 4,700 control actions, sending 225 notifications and applying 721 warnings and 98 fines, amounting to RON 1,052,000", said Sorin GRINDEANU, president of ANCOM.

Electronic communications market

In 2017, ANCOM carried out 2,643 control actions in the electronic communications market, sending 221 notifications and applying 588 warnings and 73 fines, amounting to RON 749,500.

Most fines - 25, amounting to RON 154,000 were applied to CATV network providers for breaching the terms set out in the General Authorization.

9 fines, amounting to RON 60,500, were applied to operators holding licenses for the use of radio frequencies. The most frequent breaches found during these controls were failure to comply with the provisions of authorisation documents (licenses for the use of radio frequencies and frequency assignment authorizations), as well as of the documents regarding the operation of radio stations.

The remaining 39 fines, amounting to RON 535,000, were applied to radio and television broadcasting services (RTV) providers, to telephony providers, respectively to providers of data transmission and Internet access services. The main breaches found here were non-observance of the technical data or parameters or conditions in the technical authorisations (RTV), failures in the number portability process (telephony) or in respect of the applicable damages and the corresponding procedure in the event of non-compliance with quality levels (ISP).

In October 2017, the Authority applied the highest fine in the electronic communications market, amounting to RON 200,000, to TELEKOM ROMANIA MOBILE COMMUNICATIONS S.A., for failure to comply with the legal provisions on number portability.

Radio equipment market

In the radio equipment market, ANCOM carried out 895 control actions, applying 79 warnings and 11 fines amounting to RON 102,500. The highest fine was RON 15,000 and it was applied in 4 cases, all of which involved the use of radio equipment designed to cause harmful interference.


Postal services market

ANCOM conducted 912 control actions in 2017, following which it applied 21 warnings and 8 fines amounting to RON 55,000. A frequently found breach in this market was failure to observe the obligations imposed by the general authorization regime. 459 of the control actions in the postal services market targeted the National Company Romanian Post (CNPR) as a universal service provider, following which four warnings were applied, as well as two fines amounting to RON 25,000 for failure to deliver to the addressee or to an authorized person of postal items with acknowledgment of receipt (one of the fines), and for non-compliance with the minimum quality requirements for domestic items of correspondence (the other fine).

The highest fine in the postal services market, amounting to RON 20,000, was applied to CNPR in November 2017, for non-compliance with the minimum quality conditions for domestic items of correspondence.

As for the other postal service providers, the main breaches were failure to ensure that the date of entry in the postal network is inscribed on all postal items, and tariff modification between the submission of the postal item and the delivery moment.

Market monitoring and control in 2018

In the first quarter of 2018, ANCOM performed 237 controls in the electronic communications, postal services and radio equipment market, issuing four notifications and applying 35 warnings and 6 fines amounting to RON 145,000.

In the electronic communications market, ANCOM has carried out 195 control actions so far, applying 4 notifications, 32 warnings and 5 fines amounting to RON 140,000. 3 fines amounting toRON 85,000 were applied to the National Radiocommunications Company (SNR) in March, for non-observance of the coverage obligations specified in the licenses for the use of radio frequencies in digital terrestrial system.

In the radio equipment market, ANCOM carried out 22 control actions and applied a warning for failure to observe the electromagnetic compatibility of a LED projector with sensor.
