Physical infrastructure owned by network operators and public sector organisations, to be reported to ANCOM

The National Authority for Management and Regulation in Communications of Romania (ANCOM) launched for public consultation a draft decision on the conditions and modalities of making available to the Authority information on the location, route, type and actual use of the physical infrastructure owned by network operators and by public sector organisations. The draft decision also provides for the establishment of the Single Information Point by which such information are to be reported by network operators and public sector organisations and to be accessed by the providers of public electronic communications networks.
 
Information to be reported
Network operators and public sector organisations will have to send ANCOM information – in electronic format – on the location, route, type, and actual use of physical infrastructure. Such information will be reported by completing an online form, within 2 months since the date of entry into force of this decision.
ANCOM will make available the collected information to the providers of public electronic communications networks, so that the latter could efficiently plan and use the physical infrastructure for the installation of high speed electronic communications networks.
 
The Single Information Point
On the Authority’s website, ANCOM will set up a section dedicated to the Single Information Point enabling both the network operators and public sector organisations to report information, and the providers of public electronic communications networks to access that information. The Single Information Point will be accessible based on authentication.
 
Penalties
ANCOM may sanction failure to report such information and documents in compliance with the provided deadlines, format and modalities by fine, ranging from RON 1,000 to RON 100,000.
 
Law no. 159/2016
The draft decision launched for public consultation is part of the process of laying down secondary legislation for the implementation of Law no. 159/2016, regarding the regime of the physical infrastructure of electronic communications, as well as for the establishment of measures reducing the installation costs for electronic communications networks.
The law establishes the conditions for access to public or private property for the purpose of building electronic communications networks and associated physical infrastructure elements, for access to the physical infrastructure of network operators (utility providers, railway infrastructure, roads, etc.) and for building of electronic communications networks and associated facilities.
 
Public consultation
The draft decision on the establishment of the Single Information Point, as well as on the establishment of the conditions and modalities for sending information on the physical infrastructure of network operators is available, in Romanian, here. The interested parties are invited to submit comments and proposals by 13.11.2017, to the ANCOM headquarters (2 Delea Noua Street, Bucharest 3), directly to the ANCOM Registry Office or through the Authority’s regional divisions.
