New regulations in the universal postal service field

The National Authority for Management and Regulation in Communications of Romania (ANCOM) adopted, in the Consultative Council, three decisions regarding the provision of services within the scope of universal postal service.
The amendments were mainly aimed at transposing into the secondary legislation the provisions of Government Ordinance no. 27/2016 on the amendment and completion of the Government Emergency Ordinance no. 13/2013 regarding the postal services, the last provisions of this norm entering into force on 1 January 2017. Therefore, the conditions and procedure for the designation of universal service providers, and the rights and obligations of a designated provider were updated and the process of assessing compliance with the quality objectives incumbent on such a provider was optimized.
 
Conditions and procedure for the designation of universal service providers
The new decision provides, in line with the primary legislation, that ANCOM will analyze and establish the amount of the net cost resulting from the provision of services within the scope of universal service, communicating it to the Ministry of Communications and Information Society (MCSI). Subsequently, the net cost compensation mechanism, including funding sources, will be established by government decision, at the MCSI initiative.
The decision on amending and completing ANCOM President’s Decision no. 541/2013 on the conditions and procedure for the designation of the universal service providers in the field of postal services will be sent for publication in the Romanian Official Journal and will come into force on the date of its publication.
 
CNPR’s rights and obligations as a universal service provider
Bulk mail services have been excluded from the scope of universal postal service. This amendment reflects the changes in the primary legislation that define a number of bulk postal items, the services processing these categories of items being no longer subject to universal service obligations.
The decision on amending and completing ANCOM President’s Decision no. 1158/2013 regarding the designation of the National Company Romanian Post (CNPR) as a universal service provider in the postal services field will be communicated to the universal service provider and will enter into force from 1 January 2018.
 
Quality objectives
ANCOM also updated the provisions of the secondary legislation regarding the conditions and the procedure for assessing the degree of fulfillment of the minimum quality requirements, so that they cover exclusively the domestic correspondence items from the fastest standard category within the scope of universal service, considering the modification - at the level of primary legislation - of the categories of items subject to the quality requirements that a universal service provider must observe.
The decision on establishing the conditions and the procedure for assessing the degree of compliance with the minimum quality requirements for the delivery of domestic correspondence items from the fastest standard category imposed by Decision no. 1158/2013 on the designation of the National Company Romanian Post (CNPR) as a universal service provider in the postal services field will be communicated to CNPR and will abrogate ANCOM President's Decision no. 583/2014.
