The general authorisation regime for the provision of electronic communications networks and services

The electronic communications networks and services are provided pursuant to the general authorisation regime adopted by the regulatory authority, which states the rights and obligations of the providers of electronic communications networks and services. At present, the authorisation procedure for the persons who intend to provide electronic communications networks or services, as well as the terms of provision are set out by the ANCOM President’s Decision no.987/2012 on the general authorisation regime for the provision of electronic communications networks and services.

 
The currently in force decision currently in force distinguishes between the persons who have the obligation to submit a/the notification, the persons who do not have such an obligation but are applied the specific rights and obligations provided by the general authorisation, as well as those exempted from the general authorisation regime, and, in this respect:
 
The persons intending to provide public electronic communications networks or publicly available electronic communications services must submit a notification thereon to ANCOM, on the day of starting the activity at the latest.
 
The persons who do not have the obligation to submit a notification but are applied the specific rights and obligations provided by the general authorisation regime:
 
  • the persons intending to provide electronic communications networks by means of radio frequencies allotted for experimental or occasional transmissions;
  • the foreign persons with main headquarters in other Member States of the European Union or of the European Economic Area who intend to provide mobile electronic communications services onboard ships and aircraft registered in these states;
  • the persons who, as a result of the international agreements in which Romania is a party concerning the coordination of the destination of certain radio frequencies to ensure cross-border electronic communications services, request to be awarded the right to use these limited resources but do not intend to provide on their own behalf and liability electronic communications services to the end-users established in Romania;
  • the persons who provide electronic communications networks or services exclusively for their own needs (the provisions regarding the suspension, cessation or withdrawal of the right to provide electronic communications networks or services or of the right to use radio frequencies will apply to them as appropriate).
 
The persons exempted from the general authorisation regime:
 
  • the providers who conduct designing, deployment and maintenance activities related to the electronic communications networks, as installation, maintenance or connectionof the electronic communications equipment;
  • the providers of services consisting exclusively in the provision of content sent by means of the electronic communications networks or services, or whereby the editorial control over this content is exercised, or which allow the storage and subsequent accessing of the transmitted content.
!!! We recommend all interested persons, especially the providers of electronic communications networks or services, to carefully study the provisions of Government Emergency Ordinance no.111/2011 on electronic communications, approved with amendments and completions by Law no.140/2012 as well as of ANCOM President’s Decision no.987/2012 on the general authorisation regime for the provision of electronic communications networks and servicesin order to clearly identify all the rights and obligations they have or will have in their relation with the users, with the other providers of electronic communications networks or services and with ANCOM !!!
